2. Content Ownership and Intellectual Property

All content published on rhysmerriman.com is the intellectual property of Merriman Solutions Pty Ltd. This includes written copy, frameworks, methodologies, industry observations, data analysis and any tools or templates made available for download or reference on this website. All rights are reserved.

Visitors may read, reference and share links to this website. Visitors may not reproduce, adapt or present any content from this website as their own. This applies to written content, structural frameworks and any proprietary methodology described on this site, including the Revenue Diagnostic methodology.

The diagnostic document produced for a prospect reflects that prospect's own business data. The prospect owns those findings as they relate to their own business. The prospect does not own the methodology, the benchmark data or the diagnostic framework used to produce those findings.

3. Not Professional Advice

The content on this website reflects the professional experience and industry observations of Merriman Solutions Pty Ltd as a revenue operations practitioner. Nothing on this website constitutes financial advice, accounting advice, legal advice or formal business consulting of any kind.

Any figures, estimates or projections referenced on this website, including benchmark data about inactive customer pool values, declined work volumes or recoverable revenue estimates, are illustrative. They are drawn from industry sources and applied at a sector level. They do not represent a guarantee, forecast or projection for any specific business.

Visitors who require financial, legal or accounting advice are directed to engage a qualified professional in the relevant field.

4. Nature of the Revenue Diagnostic

The Workshop Revenue Diagnostic is an estimate. It is produced using benchmark data for the specialist automotive workshop sector and, where the prospect provides a data export, the prospect's own operational records.

The diagnostic is not a formal audit. It is not accounting or financial advice. It is not a binding valuation. The figures presented are estimates based on industry benchmarks and the information provided at the time of the call. Actual recoverable revenue will vary by business.

5. What the Diagnostic Does Not Include

The diagnostic identifies and estimates the value of recoverable revenue in the prospect's existing database. No database cleaning, merging or correction of any kind is performed as part of the diagnostic. No campaign is built. No messages are sent.

The diagnostic shows the money. It does not fix the data.

6. Data Handling and Privacy

What information is collected

At the point of booking a diagnostic call, the following information is collected via the intake form: business name, management software type, approximate customer record count and the contact details of the person making the booking. Where a prospect chooses to provide a data export before or during the call, that export is received and used solely to produce the diagnostic estimate.

Visitors who submit an enquiry through any contact or booking form on this website provide their information voluntarily. That information is used solely to respond to the enquiry or to fulfil the booking requested. It is not added to any marketing list without explicit consent.

How information is stored and used

Information collected through this website is stored in GoHighLevel. It is used solely to produce the diagnostic estimate for the individual who provided it or to respond to the relevant enquiry. It is not sold, shared with third parties or used for any other purpose.

Data export retention

Any data export provided by a prospect is used only for the diagnostic. If no paid engagement follows the diagnostic call, the data export is deleted within 30 days of that call. This applies regardless of the format in which the export was provided.

Privacy Act 1988 (Cth) and the Australian Privacy Principles

The contact details collected from individuals who book or enquire through this website constitute personal information under the Privacy Act 1988 (Cth). Merriman Solutions Pty Ltd handles that personal information in accordance with the Australian Privacy Principles. Personal information collected through this website is not disclosed to third parties except where required by law. It is not disclosed to overseas recipients without consent.

Individuals have the right to request access to, or correction of, their personal information held by Merriman Solutions Pty Ltd. Requests can be made by emailing hello@rhysmerriman.com. Merriman Solutions Pty Ltd will respond to access and correction requests within a reasonable time.

7. External Links

This website may contain links to third-party websites, publications, tools or platforms. These links are provided for reference only.

Merriman Solutions Pty Ltd does not control the content of any linked third-party website and does not endorse it.

Merriman Solutions Pty Ltd accepts no responsibility for the accuracy or availability of third-party content or for any outcome arising from a visitor's use of a linked website.

Visiting a linked third-party website is at the visitor's own risk and is governed by that website's own terms and conditions and privacy policy.

8. Accuracy of Website Content

Merriman Solutions Pty Ltd takes reasonable steps to ensure the content on this website is accurate and current. Industry data, benchmark figures and market statistics are sourced from published industry reports and research.

These figures are subject to change. No warranty is made that all content on this website is current, complete or free of error at the time of access.

9. Cookies and Tracking

Google Analytics

This website uses Google Analytics, which collects anonymous usage data including pages visited, time spent on the site, device type and approximate geographic location. It does not collect names, email addresses or any personally identifying information.

This data is collected to understand how visitors use the website so that its content and structure can be improved.

Framer

rhysmerriman.com is built on Framer. Framer sets functional cookies that are necessary for the website to operate correctly, including the booking system. These cookies are not used for advertising, retargeting or tracking visitor behaviour across other websites.

Because these cookies are strictly functional, no opt-out mechanism applies. Their sole purpose is to enable core website features.

10. No Commitment Created by Booking or Attending

Booking a diagnostic call creates no obligation on the prospect. Attending the call and receiving the diagnostic document creates no obligation on the prospect. The diagnostic document is theirs to keep unconditionally, regardless of what they decide after receiving it.

No follow-up, no purchase and no further engagement of any kind is required.

11. No Commitment Created Beyond the Diagnostic

Delivering the diagnostic creates no obligation on Merriman Solutions Pty Ltd to proceed to any further engagement. The diagnostic is a standalone product. Merriman Solutions Pty Ltd reserves the right to determine whether any further engagement is appropriate based on the diagnostic findings.

Where the contactable pool identified in the diagnostic is insufficient to support a viable engagement, no paid offer will be made. That is the diagnostic performing its function, not a rejection of the prospect.

The delivery of the diagnostic document is the full extent of the commitment made at the point of booking.

12. Limitation of Liability

The diagnostic is provided in good faith, based on information available at the time of the call. No warranty is made that the estimates are accurate.

To the extent permitted by law, Merriman Solutions Pty Ltd's liability in connection with the diagnostic is limited to the cost of the diagnostic, which is nil.

Nothing in these terms excludes, restricts or modifies any consumer guarantee or right that applies under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded. These terms operate as a scope limitation. They do not purport to exclude liability for misleading or deceptive conduct or any other non-excludable statutory right.

13. Changes to These Terms

Merriman Solutions Pty Ltd reserves the right to update these terms at any time. Changes take effect from the date they are published on this website. Continued use of this website after a change is published constitutes acceptance of the updated terms.

Visitors are encouraged to review these terms periodically. The effective date displayed at the top of this document is updated each time a revision is made.

14. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising from your use of this website or your receipt of the diagnostic is subject to the exclusive jurisdiction of the courts of New South Wales.

15. Acceptance

By booking a diagnostic call through this website, you confirm that you have read and accept these terms. No signature is required. The act of booking constitutes acceptance.
